1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of Pin Reaper, the golf tracking application and related services (collectively, the "Service") operated by Pin Reaper Limited, a company registered in England and Wales ("we", "us", or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Definitions

  • "Account" means the personal account you create to access the Service
  • "Content" means any data, text, information, statistics, or other materials you submit to the Service
  • "User" or "you" means the individual accessing or using the Service
  • "Round" means a golf round recorded in the Service
  • "Handicap Index" means the calculated handicap estimate provided by the Service

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 13 years of age to use the Service. By creating an account, you confirm that you meet this age requirement.

3.2 Account Creation

To use certain features of the Service, you must create an account by providing accurate, current, and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

3.3 Account Accuracy

You agree to keep your account information accurate and up to date. Failure to do so may result in your inability to access the Service or termination of your account.

4. Description of Service

Pin Reaper is a golf tracking application that allows you to:

  • Record and track golf rounds
  • Calculate estimated handicap indices
  • View statistics and performance metrics
  • Share rounds with friends
  • Access golf course information
  • Post comments and reviews
  • Connect with other golfers

The Service is hosted on Amazon Web Services (AWS) in London, United Kingdom.

5. Subscription and Payment Terms

5.1 Free Trial

New users are eligible for a 30-day free trial period. You will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid monthly subscription unless you cancel before the trial ends.

5.2 Monthly Subscription

After the trial period, the Service is provided on a monthly subscription basis. Pricing will be displayed in the application and on our website before you complete your subscription.

5.3 Payment Processing

Payments are processed securely through our third-party payment provider. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

5.4 Automatic Renewal

Your subscription will automatically renew each month unless you cancel before the next billing date. You will be charged the then-current subscription fee.

5.5 No Refunds

All subscription fees are non-refundable. We do not provide refunds or credits for partial months of service, or for periods when your account was inactive.

5.6 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.

5.7 Price Changes

We reserve the right to modify subscription pricing. We will provide you with at least 30 days" advance notice of any price changes. Continued use of the Service after the price change takes effect constitutes acceptance of the new pricing.

5.8 Failed Payments

If payment fails or your payment method is declined, we may suspend or terminate your access to the Service until payment is successfully processed.

6. User Content and Conduct

6.1 Your Content

You retain ownership of all Content you submit to the Service. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your Content solely for the purpose of operating and improving the Service.

6.2 Sharing Rounds

You may share your recorded rounds with friends on the Service. You are responsible for managing your privacy settings and choosing what information to share.

6.3 Comments and Reviews

You may post comments and reviews about golf courses and related topics. When posting Content, you agree not to:

  • Post false, misleading, or defamatory information
  • Violate any third party"s intellectual property rights
  • Post offensive, abusive, or harassing content
  • Spam or post unsolicited advertising
  • Impersonate any person or entity
  • Post content that violates any applicable laws

6.4 Content Monitoring

We reserve the right, but have no obligation, to monitor, review, or remove any Content that violates these Terms or is otherwise objectionable.

6.5 Content Removal

We may remove any Content at our sole discretion without notice. We are not responsible for any loss of Content.

7. Intellectual Property Rights

7.1 Our Property

The Service, including all software, designs, text, graphics, logos, and other materials (excluding User Content), is owned by Pin Reaper Limited and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms.

7.3 Restrictions

You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Remove any copyright or proprietary notices
  • Use the Service for any commercial purpose without our written consent
  • Access the Service through automated means (bots, scrapers, etc.)
  • Attempt to gain unauthorized access to any part of the Service

8. Disclaimers and Limitations

8.1 Handicap Calculations

IMPORTANT:

Handicap indices and calculations provided by the Service are estimates only and are unofficial. They should not be used for official tournament play or formal handicap purposes. For official handicap indices, please consult your local golf association or authorized handicap service provider.

The Service uses the World Handicap System (WHS) rules as a guideline, but calculations may not be identical to official handicap services.

8.2 Course Data Accuracy

Course information, including hole layouts, yardages, ratings, and slope ratings, is provided for informational purposes only. We do not guarantee the accuracy, completeness, or currency of any course data. Course information may change without notice.

8.3 Service Availability

We strive to provide reliable service but do not guarantee that the Service will be:

  • Available at all times without interruption
  • Free from errors, bugs, or security vulnerabilities
  • Compatible with all devices or software

8.4 "As Is" Basis

9. Limitation of Liability

9.1 Exclusion of Damages

This applies whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

9.2 Maximum Liability

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in subscription fees during the 12 months preceding the claim, or £100, whichever is greater.

9.3 Exclusions

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such cases, our liability will be limited to the maximum extent permitted by law.

10. Data Protection and Privacy

10.1 Data Processing

We process your personal data in accordance with:

10.2 Data Location

Your data is stored on servers located in London, United Kingdom (AWS EU-West-2 region).

10.3 Data Retention After Account Deletion

If you delete your account, we will retain your personal data for 1 month after deletion to allow for account recovery. After this period, your data will be permanently deleted from our systems, except where we are required to retain it by law.

11. Termination

11.1 Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account through the Service settings.

11.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

  • You violate these Terms
  • You engage in fraudulent activity
  • We are required to do so by law
  • We discontinue the Service

11.3 Effect of Termination

Upon termination:

  • Your right to access the Service will immediately cease
  • We may delete your account and Content
  • You remain responsible for all fees incurred prior to termination
  • Provisions that should survive termination will continue to apply

12. Modifications to the Service and Terms

12.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12.2 Changes to Terms

We may update these Terms from time to time. When we make changes, we will:

  • Update the "Last Updated" date at the top of this document
  • Notify you via email or through the Service
  • Provide you with 30 days" notice for material changes

Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

13.2 Jurisdiction

You agree that any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13.3 Dispute Resolution

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pin Reaper Limited regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

14.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

14.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, strikes, or government actions.

BY CREATING AN ACCOUNT OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
